\nCrimeNonth East MDlna Control \nG E S T \nA comprehensive and independent news summary for the Law Enforcement Professional \n# Georgia Panel Weighs Rules RequiringPolice To Adopt Interrogation Policies\n\nGeorgia legislators are gathering information in preparation for thenext session that would require lawenforcement agencies to adopt writtenrules for interrogations and lineups. \nState Representative StephanieBenfield, who chairs the House studycommittee, has sponsored legislationthat failed in the past. \nBut she noted changes in NorthCarolina and the negative publicityabout law enforcement resulting frompost-conviction DNA analysis thatfreed six men from prison has alteredthe outlook for 2008. \nNorth Carolina earlier this yearapproved new standards for police in-terrogations and eyewitness lineupsin a series of bills designed to im-prove police efficiency and reducethe number of convictions of innocentpersons through error. \nThe “Eyewitness IdentificationReform Act”,HB 1625,requires uni-form procedures for conducting alineup in which a witness attempts toidentity a perpetrator by reviewingphotos or live people standing behinda glass window. \nThe law requires an officer with-out any knowledge of the investiga-tion to conduct the lineup.SomeNorth Carolina law enforcementagencies previously followed the \npractice. \nAnother bill,HB 1626,would re-quire police to make a video or audiorecording of all questioning sessionsto protect against constitutional viola-tions of a suspect's rights. \nThe third bill,HB 1500,wouldallow a suspect to ask for a DNA testbefore a trial and any other time sci-entists improve the quality of DNAtesting to assure that the latest tech-nology has been applied. \nPolice must hold the DNA evi-dence throughout the period of a con-vict's incarceration except for felonsthat enter a guilty plea, which re-quires only a three-year period for re-taining the DNA evidence. \nBefore destroying DNA evi-dence,however,police must notifythe felon and receive a court order al-lowing destruction because the evi-dence no longer has any significantvalue. \nBenfield said studies in Georgiafound that 83 percent of the state'slaw enforcement agencies lack spe-cific policies for interrogations orlineups and there is increasing evi-dence about the unreliability of eye-witness identification. \nDale Mann, director of the Geor-gia Public Safety Training Council, said most police agencies already \nemploy the practices that North Caro-lina placed into statutory authorityand questioned whether a requirementfor written guidelines would produce.any meaningful changes. \nMann also noted that DNA evi-dence,which is clearing individualsheld in prison for decades, wouldblock any future convictions in cir-cumstances similar to those of two ormore decades ago. \nThe study committee will presentits findings to the Georgia legislaturein 2008. \nVERMONT SEES DRUGSDRIVING
