Protection of Badgers Act 1992.It is an offence to damage or obstruct a badger sett which showssigns of current use by badgers,or to disturb a badger within a sett \nForest operations such as tree felling, timber extraction and mechanicalcultivation are potential sources of damage or disturbance to badgersetts. The Forestry Commission has consulted the Ministry of \nAgriculture,Fisheries and Food(MAFF),Scottish Office Agriculture andFisheries Department (SOAFD),Welsh Office Agriculture Department(WOAD),Agricultural Development Advisory Service (ADAS),EnglishNature (EN),Scottish Natural Heritage (SNH)and the CountrysideCouncil for Wales (CCW)in preparing this guide.t gives advice on: \n●The law concerning forest operations and badger setts. \n●Practices which will minimise damage and disturbance to badgersetts from forestry. \n●When and where to obtain further advice. \nThis guide concentrates upon safeguarding setts and badgers withinsetts. It is not intended to provide comprehensive advice on the wideraspects of managing forests for the benefit of badgers although itincludes some measures which go beyond what is strictly necessary toavoid an offence under the 1992 Act,in order to minimise disturbance tobadgers beyond the immediate vicinity of the sett. \n# BAD GER SETTSAND THE LAW\n\nThe Protection of Badgers Act 1992 consolidated earlierlegislation, namely the Badgers Act 1973,as amended,TheBadgers Act 1991 and The Badgers(Further Protection)Act 1991.The 1992 Act created a number of offences. For example, except ifpermitted by or under the Act,it is an offence to wilfully kill, injureor take a badger;to interfere with a sett by damaging orobstructing it or by disturbing a badger when it is occupying abadger sett, with intent or recklessly.A settis defined in the Act asany structure or place which displays signs indicating current use by abadger, and can be interpreted as including underground holes andother places of shelter occasionally used by badgers, such as sheds, concrete pipes or culverts etc. \nThere are also a number of statutory defences in the 1992 Act.Forexample,a defence to damaging a badger sett would be that thedamage was the incidental result of a lawful operation and couldnot reasonably have been avoided. This is not an exhaustive list ofthe offences and exceptions in the 1992 Act.Annex A lists the relevantsections of the Act.For further detail readers should consult the Actitself. The Act also contains provisions to permit (by means of alicence)certain activities which would otherwise be prohibitedunder the Act. \nThe licensing authorities responsible for the issue of licences under the1992 Act are the agricultural departments and the statutory natureconservation agencies(English Nature (EN),referred to as the NatureConservancy Council for England in the Act,Scottish Natural Heritage(SNH)and the Countryside Council for Wales(CCW). \nLicences for
