\"Notaria,\"\"Notario Publico\"and \"Consultoria\"because they are mis-leading to Cubans and other Spanish speaking people. \nGeorge A.Wigginton of New Orleanswas elected president of the Associa-tion of Professional Notaries(APN)inDecember.Mr.Wigginton is a CharterMember of ASN. \nThe notary,Nicholas F.Fuentes, was principally engaged in offering accountingservices. However,he prepared pre-incorporation agreements, articles of incor-poration,bills of sale and numerous other legal documents. \nSigned StatementCan Amount To AnOath In Louisiana \nThe Association of ProfessionalNotaries,a statewide nonprofit organ-ization,was organized in 1962 toprotect and promote the welfare andinterests of all Notaries Public in theState of Louisiana.Membership isopen to all non-attorney notaries. \nThe Court of Appeals of Louisiana,Third Circuit, has held that in certaincircumstances the signing of a docu-ment which recites that it was \"swornto\"is equivalent to taking an oath. \nAccording to \nMr.Wigginton, \nalmost every ses- \nsion of the Lou- \nisiana legislature \nThe ruling was made in the case ofPlauche-Locke Securities,Inc.V.George B.Johnson of Lake Charles.Johnson had purchased a car with thehelp of a loan from Plauche-Locke.Hemade two payments and then defaulted. The car was sold at public auction butthe proceeds were not enough to satisfythe unpaid loan. The finance companythen sued Johnson for the balance. \nproduces some \nkind of bill which \naffects notaries. \nIn 1962 a bill was \nintroduced which \nwould have cre- \nWigginton theoffice of Notary Public. The group hasan impressive record in legislativematters. \n## Procedure Challenged\n\nJohnson claimed that Plauche-Lockewas not entitled to recover because theappraisers who made the appraisementof the car prior to the auction were notsworn as required by law and thereforetheir appraisement was null and void.[Louisiana law provides that whenproperty is to be sold at judicial saleit must be appraised, and the appraisersmust take an oath to make a true andjust appraisement, otherwise the credi-tor cannot hold the debtor for anydeficiency.] \n## No“Class”Distinctions\n\nMr.Wigginton says that,in additionto its many other aims,\"APN seeks topromote and protect the stature anddignity that the office of Notary Publicdeserves. Not as 'lay'notaries and notas 'non-attorney'notaries,but as pro-fessional notaries.\" \nIn accepting the high post,Mr.Wigginton declared that he would con-tinue to lead the association in workingon a minimum fee schedule and updat-ing the group's charter and code ofethics.Another goal of APN is to re-turn to the non-attorney notary the rightto make inventories in successions. \n## No Formal Oath\n\nThe
