R.QuinnArchbishop of San Francisco. \nThe idea of public morality is by naturea limited concept, yet it is the basic prem-ise underlying the moral tradition of rea-son in public affairs. Its first principle isthat for a political society to function hu-manely,there must be some recognizedmoral order capable of statement and dis-cussion,and against which the content oflaw and policy can be tested. \n## Moral Standard\n\nThis postulate of a higher moral stan-dard does not diminish the role which lawand policy play in shaping the moral fabricof society. It is rather an affirmation thatthere is a moral content in law and policy, that these moral implications must be ex-amined and that they must be tested anddebated in society. At the same timeit im-plies that law and policy play a limitedmoral role and that they exist within abroader framework of moral principles towhich they must be continually related. \nThe way in which morality, law and pol-icy converge in a given issue has been il-lustrated most recently in the Bakke case. The eminent legal scholar,Paul Freund, argued that the real meaning of the Bakkedecision“is that we are dealing with acomplex problem whose outer contourscan be drawn by judges, but whose resolu- \ntionlies within awide spectrumof moraland political choices to be made by our-selves,choices that must consider notonly individual rights, but the health of thesociety within which these rights are as-serted.” \n## Public Morality\n\nProfessor Freund clearly reflects the as-sumptions which undergird the idea of apublic morality. These include such thingsas the social nature of the person, hencethe need to test the social consequences ofan action as well its personal implications;the admittedly crucial but limited role oflaw, hence the need to refer beyond civillaw to assess its justice;and, thirdly, thecontinuing relationship of law to moraljudgement. Thus, the concept of publicmorality","cbCaibLJt03paIQk","https://ap.wps.com/l/cbCaibLJt03paIQk","pdf",1794757,"English","# “Federal Regulation and Its Effect Upon Cities”\n# Archbishop Quinn Discusses Public Morality\n##
