CONFLICT BETWEENLEGISLATURE AND HIGH COURT\n\nMassachusetts has become the 37th state toadopt a new death penalty law-a move that allbut insures a renewed confrontation on the matterbetween the legislature and the state Supreme Court.  \nThe legal questions may center this time on aprovision inserted into the law in an attempt to ex-plain away the court's previous reservations aboutthe constitutionality of the measure.  \nThe provision flatly states that the legislature-not the courts-has the authority to determinewhether the death penalty is a deterrent to crime.And it includes the legislature's statement that death\"is most probably an effective deterrent\"to the 12specific types of murders listed in the law.  \nBut Harvard Law School Professor Alan M.Dershowitz,an expert in
