EXECUTIONS NOW?”-Amsterdam \nFRIDAY FLASHES-JU LY 8+hFrom Address by \nANTHONY G.AMSTERDAMProfessor of Law,Stanford University \n\"The most basic fact,of course,is thatcapital punishment means taking living, breathing men and women, stuffing theminto a chair, strapping them down,pull-ing a lever, and exterminating them.Wehave almost forgotten this fact becausethere have been no executions in thiscountry for more than ten years, exceptfor Gary Gilmore whose combined suicideand circus were so wildly extravagant asto seem unreal. \n## Awaiting Death\n\nThe courts have now said that we canstart up executions again,if we want to. \nWhat this means is,first, that we bring a man or woman into court and put them through a trial for their lives. They are \nSHOULD WE NOT CHOOSE TO STOP SELF-DELUDING, \nexpected to sit back quietly and observedecent courtroom decorum throughout aproceeding whose purpose is slowly andsystematically to kill them. The jury hearsevidence and votes;and you can alwaystell when a jury has voted for death be-cause they come back into court and theywill not look the defendant or defensecounsel in the eyes. \nThe judge pronounces sentence and thedefendant is taken away to be held in acel!for two to six years, hoping that hisappeals will succeed, not really knowingwhat they are all about, but knowing thatif they fail,he will be taken out andcinched down and put to death. \nMost of the people in prison are reason-ably nice to him,and even a little apolo-getic;but he realizes every day for that seven hundred or twenty-one hundreddays that they are holding him there help-less for the approaching slaughter;and(Continued on next page) \n## “NOBODY WILL RAISE A FINGER TO SAVE HIM”\n\nAMSTERDAM(Continued from preceding page)that, once the final order is given, theywill truss him up and kill him,and thatnobody in that vast surrounding machin-ery of public officials and servants of thelaw will raise a finger to save him. \n## Spare the Deseriptions\n\nI will spare you descriptions of theexecution itself.Mr.Younger,when hespeaks to you next week, will probablytell you about some very horrible mur-ders,and I decline to insult your intelli-gence by playing 'can you top this'withissues of life and death.I ask you only toremember two things,if and when youhear such deseriptions. \nFirst,the murders being described arenot murders that are being done by us,or in our name,or with our approval;andour power to stop them is exceedinglylimited even under the most exaggeratedsuppositions of deterrence.Every execu-tion,on the other hand,is done by ourpaid servants,in our collective name, andwe can stop them all.Do not be bam-boozled into thinking people who areagainst executions are in favor of murders. \nJL 10 \n## Absurd Justifications\n\nSecond,please remember therefore thatdescriptions of murders are relevant tothe subject of capital punishment only onthe theory that two wrongs make a rightor that killing murderers can assuage theirvictims'sufferings or bring them back tolife,or that capital punishment is the best \n77 \nUMI \ndeterrent to murder. The first two proposi-tions are absurd;the third is debatable. \nMy point is only that deterrence is de-batable,whereas we know that personswhom we execute are dead beyond recall,no matter how the debate about deter-rence comes outThat is a sufficient rea-son,I believe, why the burden of proof onthe issue of deterrence should be placedsq","cbCaicJOGi994Wpk","https://ap.wps.com/l/cbCaicJOGi994Wpk","pdf",1827926,"English","# \"Danger for the West\"\n## Awaiting
