LUMPUR:The High Courtin Melaka ruled yesterday thatthe land housing the 120-year-old Sacred Heart Convent schoolbelongs to the state government. \nThe respondent argued thatLot 6 is state land, was neverlegally registered under the ap-plicants’names,and that theDutch Title Deed was merely alotindex, not an ownership docu-ment. \nJudge Datuk Mohd Radzi Ab-dul Hamid made the ruling whiledismissing the Canossian Sisters'and the Portuguese Mission's le-gal claim to the land, known asLot 6. \nMeanwhile,the applicants ar-gued that they had a pre-existinglegal and beneficial ownershipinterest in Lot 6 and the respon-dent's refusal to perform their le-gal duty to issue the replacementtitle was illegal. \nThe suit, filed in May 2022,wasbrought by two statutory entitiesclaiming ownership of the prop-erty,which had been occupiedand administered by the Por-tuguese Mission and the Canos-sian Sisters since 1905. \nDissatisfied with the respon-dent's decision, the applicantsthen filed a judicial review,seek-ing a court determination on the.matter. \nThe land, located near the A'Famosa hill fort, originallyhoused the Portuguese MissionGirls'School, which was later re-named Convent of the SacredHeart and is now known as SKSacred Heart Convent under theEducation Ministry. \nRadzi,in his ruling, said pos-session and occupation were dis-tinct legal rights and could not besynonymous with ownership. \n\"This court does not find anydocument that clearly points tothe applicants'legal title to Lot 6and that it was registered in ei-ther of their names. \nThe applicants claimed that pre-existing interest in thelegal and beneficial ownership ofLot 6,\"he said in his grounds ofjudgment published on the judi-ciary website. \nHowever,the title deed, whichwas said to have been in the
