The ordinance sets definitions, storage and junk-yard controls, zoning coordination, inspection and notice procedures, enforcement and due process, abatement and cost recovery, and municipal civil infraction remedies authorized by Michigan law.","AMBER TOWNSHIP JUNK ORDINANCE  \nOrdinance No. 2024-1028, amended by Ordinance No. 2024-1028AM  \nPREAMBLE  \nThe Board of Amber Township, Mason County, Michigan, adopted Ordinance No. 2024-1028 on October 28, 2024, and became effective 30 after its publication, and hereby after two years of enforcement, believes it is necessary to amend the Ordinance, based on the same findings and consideration of that the public peace, health, safety, and welfare of the citizens of Amber Township are threatened by the accumulation, storage, abandonment, or discarding of garbage, rubbish, construction and demolition debris, junk, junk motor vehicles, parts of junk motor vehicles, and dangerous or blighting conditions associated with inhabited, vacant, or abandoned structures or improvements on premises within the Township. Such conditions may result in soil and water pollution, fire hazards, injury to persons, threats to public health from disease and pests, blight, potential blight, and other conditions harmful to the public welfare, particularly where such conditions are exposed to public view or access and are not otherwise adequately regulated by state law, township ordinance, or village ordinance.  \nThe Board further determines that this Ordinance is necessary to prevent blight and nuisances; to protect land and water resources; to preserve property values; and to provide fair, reasonable, and enforceable standards for the regulation and abatement of junk and related conditions within Amber Township.  \nARTICLE I. NAME  \nSECTION 1.1 NAME  \nThis Ordinance shall be known and cited as the Amber Township Junk Ordinance. For purposes of brevity, it may be referred to in this Ordinance as the “Ordinance.”  \nARTICLE II. PURPOSE AND AUTHORITY  \nSECTION 2.1 PURPOSE  \nThe purpose of this Ordinance is to regulate and control the accumulation, storage, abandonment, discarding, removal, and disposal of junk and related materials within Amber Township; to promote the public health, safety, and welfare; to protect land and water resources; to prevent blight and nuisance conditions; and to regulate matters of legitimate Township concern by:  \n1. Defining certain terms used in this Ordinance.  \n2. Regulating the conditions under which junk and junk motor vehicles may be stored on premises within the Township.  \n3. Regulating and coordinating with applicable zoning ordinances the use and operation of junk yards, salvage yards, repair facilities, and similar uses within the Township.  \n4. Providing for inspection, notice, due process, enforcement, abatement, cost recovery, and sanctions.  \n5. Providing municipal civil infraction enforcement rules and other remedies authorized by law.  \n6. Providing other miscellaneous provisions necessary for the regulation of Township affairs.  \nSECTION 2.2 LEGAL BASIS  \nThis Ordinance is enacted pursuant to the authority granted to townships under 1945 PA 246, as amended, MCL 41.181 et seq., including the authority to adopt ordinances regulating the public health, safety, and general welfare of persons and property and to provide sanctions for violations of township ordinances. This Ordinance is also intended to be enforced, where applicable, as a municipal civil infraction under Chapter 87 of the Revised Judicature Act, MCL 600.8701 et seq.  \nSECTION 2.3 RELATIONSHIP TO OTHER LAWS  \n1. This Ordinance shall be construed and enforced in a manner consistent with applicable federal law, Michigan law, the International Property Maintenance Code, the Mason County zoning ordinance, and any other applicable Township ordinance and/or regulations.  \n2. Compliance with this Ordinance does not excuse compliance with any other applicable law, ordinance, permit, license, or approval.  \n3. Ifa condition or activity is regulated by more than one law or ordinance, the more restrictive provision shall apply, unless otherwise prohibited by law.  \n4.
