Monday,Apri121,1986 \n# ACE DRUMMING UP CLASS ACTION AGAINST ASBESTOS MANUFACTURERS\n\nThe American Council on Education(ACE)is trying to mount a class-action law-suit that would make manufacturers pay for removing asbestos from colleges anduniversities. \n\"Each and every college and university in this country with friable asbestosmaterials has been or will be confronted with a substantial asbestos-removalbill,\"said a letter sent last month to 2,200 institutions by ACE and its af-filiate,the National Association of College and University Business Officers. \nFearing\"potentially mind boggling\"removal costs ranging from almost $1 mil-lion to $8 million or more, about two dozen ACE members agreed to launch aclass-action suit against asbestos manufacturers. Many building owners, whoare obligated by law to remove the life-threatening material from buildings tobe renovated or demolished, have charged manufacturers with selling asbestoswithout warning of its hazards. \nLimited ResponseACE is inviting other schools to join the suit,accord-ing to the group's general counsel,Sheldon Steinbach, but,so far, responseto ACE's call to arms has been\"limited.I don't understand the reluctance\"ofschools to sue for removal costs, especially in light of Mercer University's \n$2.4 million victory last week,he said(see story, page 2)。 \n\"Whether it is a class action or individual action, they should do somethingbefore the statute of 1imitations runs out,\"Steinbach added.Statutes of lim-itation run for different periods from state to state, and some states'lawsbegan ticking at the point when colleges\"should have known\"of their obliga-tion to remove asbestos and estimated its cost. \nFederal regulators have ordered all materials containing friable asbestos re-moved before any building owner renovates or demolishes a structure。Thecrumbly, gray or white material was used in many post-1920 buildings for boilerand pipe insulation, and by the 1950s many builders used a spray-on form ofasbestos for fireproofing or acoustic insulation,ACE's letter explains.Afterbeing linked to cancer, asbestos was outlawed in stages during the 1970s. \nManufacturers have argued the risks are low under normal conditions.W.R.Grace&Co.argued the level of exposure to asbestos in its acoustic ceilingmaterials at Mercer would be low and that no evidence indicated medical risk. \nACE's suit would match a class action on behalf of public and private elemen-tary and secondary schools:In Re:Asbestos School Litigation(83-0268),filedin U.S.district court in eastern Pennsy1vania.(more) \nApril 21,1986 \n# ACE DRUMMING UP CLASS ACTION AGAINST ASBESTOS MAKERS(Cont.)\n\nACE is proposing a \"voluntary class action,\"which would benefit only thosecolleges and universities that attach their names to the suit, and not highereducation institutions in general,Steinbach said. Some state colleges anduniversities already may be joined in asbestos removal suits by their stateattorney generals on behalf of all state agencies,he added. \nThe ACE letter asks litigants to contribute $15,000 to the suit,or $30,000 forthose expecting to recover more than $1 million. The suit will seek the costsof asbestos inspections, testing, evaluation, control, removal and costs suchas damage done to buildings during asbestos removal, says ACE.--Maggie Hume \n# MERCER UNIVERSITY WINS $2.4 MILLION IN ASBESTOS SUIT\n\nMercer University,a 5,000-student school in Macon,Ga.,has won $2.4 millionfrom two asbestos manufacturers in one of few suits to go to trial for thecosts of removing the banned insulation material. \n\"We are very pleased that the jury agreed with Mercer that the costs of re-moving and replacing these hazardous materials should rest on the companiesthat knew of the danger and continued to sell the products as safe,\"saidMercer's general counsel,Corinne Houpt. \nThe award, handed down April 11 by a federal district court jury in Macon, included $400,000 for removing asbestos-containing materials from three uni","cbCairIYMqrs4JTe","https://ap.wps.com/l/cbCairIYMqrs4JTe","pdf",1768019,"English","# ACE DRUMMING UP CLASS ACTION
