12-16”meets the test of prob-able cause despite alleged factual er-rors,ruled the 3rd Circuit Court ofAppeals.  \nThe broad affidavit with pur-ported errors has created what the 3rdCircuit described as a “cottage indus-try”of litigation to nullify subpoenasthat resulted from one of the JusticeDepartment's earliest and biggest in-vestigations into Internet child por-nography.  \nThe FBI disclosed“OperationCandyman”in 2002 with the firstwave of arrests of defendants whoregistered for the “Candyman”and“Girls 12-16”e-mail services on Ya-hoo.  \nFBI agents and state and locallaw enforcement nationwide havesubsequently made thousands of ar-rests of e-mail subscribers in a crack-down on a conspiracy that stretchedover at least 20 states.  \nThe FBI affidavit claimed everysubscriber to the websites automati-cally received all of the pornographice-mail that was generated.But Yahoopresented evidence that each sub-scriber had to initiate a notice to re-  \nalso provided the FBI with 3,397 e-mail addresses of Candyman sub-scribers.  \nDespite the alleged error in theFBI affidavit,the 3rd Circuit affirmedthat the affidavit contained sufficientfactual information to meet the con-stitutional standard for probablecause.  \nSpecial Agent Geoffrey Binneyworking in an undercover capacityfirst discovered the “Candyman”website and created the subpoenatemplate that FBI agents used na-tionwide for arrest warrants.  \n“We note at the outset of our dis-cussion that while this case seems tobe the only one that has come beforethis court arising from“OperationCandyman,\"numerous other courtshave addressed similar challenges.With over three thousand memberslinked to the e-groups in question,Agent Binney's misrepresentationshave spawned a
